Who is responsible for sustainable urban drainage (SuDS)?

Recent legislation means you could soon be taking on some of the responsibility for creating and managing sustainable drainage systems (SuDS).

Under the Flood and Water Management Act 2010, the local authority SuDS Advisory Board must monitor and manage the specification, design, implementation, and maintenance of SuDS schemes.

However, despite the responsibility for managing SuDS being placed on the advisory boards, developers, builders, and even homeowners will share this responsibility.

The key concern is to manage water run-off by allowing it to seep naturally through the ground via permeable paving.

Rear garden patio water drainge

Submitted 4 years 1 month ago

I'm trying to understand the regulations and guidance for a neighbours large rear garden patio area 84sqrm and car park area of 25sqrm that has inadequate drainage. Currently drainage flows down garden towards houses on a decline of say 5 degrees. Initially there was no drainage and I had flooding onto my next door property. Now a gully has been added thst connects to house rainwater drainage. This drainage is inadequate and I still have flooding issues. Council planning and building control have said it doesn't contradict planning or building control measures. What can I do to get owner to enforce a change thx

Hello there

Thanks for getting in touch.

This would appear to be a civil matter between yourself and your neighbour and potentially outside the scope of the building regulations as you have been informed by your local authority. I can only suggest seeking your own professional advice to hopefully resolve the situation.

Kind regards

who is responsible for repair to concrete drainage channel running under the rear of my property? It flows from a drain feeding into it across a major street and empties into another channel several yards downstream.
