Building Safety Levy (England) Regulations

The Building Safety Levy (England) Regulations were made in November 2025 and will come into force on 1 October 2026 (just over four months away). These regulations introduce a new form of tax - a levy charge - for certain types of residential development.
It is a tax that will have to be paid to government through the building regulation process and will be collected by local authorities in England on behalf of the Government. This levy will sit alongside (not replace) other forms of development charges such as CIL, Section 106 and the Residential Property Developer Tax.
To assist developers with some of the basics of the Building Safety Levy regulations, LABC has produced an online resource, responding to frequently asked questions about the charging and collection process of the Building Safety Levy. LABC hopes the resource will raise awareness about the regulations and how they are intended to work.
